Welcome to Barahnaja Organics.
The website www.barahnajaorganics.com and products sold through it are operated and sold by Himalayan Harvest, trading under the name Barahnaja Organics with permission from the owner of that trade name.
Throughout these Terms, “Barahnaja Organics”, “we”, “us” and “our” refer to Himalayan Harvest operating under the trade name Barahnaja Organics. “You” and “your” refer to visitors, users and customers of this website.
By accessing this website or placing an order with us, you agree to these Terms of Service and the policies referred to in them.
1. Our Products
Barahnaja Organics offers food and agricultural produce sourced from farms, orchards, forests and traditional producing regions of the Himalayas and adjoining agricultural areas.
Our range may include fresh seasonal fruits, honey, ghee, pulses, beans, millets, cereals, grains, spices, condiments, gift packs, sampler sets, combinations and other food products.
Many of our products are agricultural, natural and minimally processed. Reasonable variations may therefore occur between seasons, harvests and batches, including differences in:
- size and shape;
- colour and appearance;
- flavour and aroma;
- texture;
- moisture content;
- density;
- grain or seed size;
- crystallisation; and
- other characteristics naturally associated with agricultural produce.
Such natural variation does not by itself constitute a product defect.
We make reasonable efforts to ensure that photographs and product descriptions accurately represent our products. However, natural agricultural products may not look completely identical to photographs displayed on the website.
2. Seasonal and Limited-Harvest Products
Some Barahnaja Organics products are seasonal, region-specific, small-batch or dependent upon a particular harvest.
Availability can therefore change according to season, crop conditions, harvest quantities and stock.
The display of a product on our website does not guarantee permanent or continuous availability.
We may limit quantities, temporarily make a product unavailable or discontinue a product once a harvest or batch is exhausted.
3. Pre-Orders
Certain seasonal products, particularly fresh Himalayan fruits, may be offered for pre-order before harvesting and dispatch begin.
A pre-order reserves produce from an upcoming harvest. It does not mean that the product is ready for immediate dispatch.
Any anticipated harvesting or dispatch period shown on the website is an estimate. Agricultural harvests may be affected by ripening conditions, rainfall, weather, road connectivity, landslides, logistics and other circumstances outside our reasonable control.
If a material delay occurs, we may communicate an updated expected timeline.
Cancelling a pre-order
A customer wishing to cancel a pre-order should email:
A cancellation and refund may be accepted where the produce allocated to the order has not yet been harvested/plucked, packed or otherwise prepared for fulfilment.
Once the produce allocated to an order has already been harvested, packed or dispatched, cancellation may no longer be possible because of the perishable nature of fresh produce and the costs already incurred in preparing the order.
If we are unable to fulfil a prepaid pre-order, the amount paid for the unfulfilled product will be refunded.
Nothing in this section restricts any statutory remedy available to a consumer where goods supplied are defective, damaged, incorrect or otherwise not in conformity with applicable law.
4. Fresh Fruit Weight, Count and Grading
Fresh fruit is agricultural produce, and individual fruits naturally differ in size and weight.
Where an apple or other fruit pack is described using an approximate weight, fruit-count range, grade or combination of these, the specifications stated on the relevant product page should be read together.
The total weight of fruit within a count-based pack may naturally vary because of:
- individual fruit size;
- moisture and water content;
- stage of the harvest season;
- maturity;
- natural variation between fruits; and
- the grading of that particular harvest.
Late-season fruit may naturally contain less moisture while developing a sweeter or more concentrated flavour.
Where a weight is expressly described as approximate, some variation around that figure may therefore occur.
The stated fruit weight refers to the fruit itself, and does not include the weight of the shipping carton, protective materials or outer packaging unless specifically stated otherwise.
Nothing in these Terms permits us to supply less than any net quantity that we are legally required to provide or that has been expressly guaranteed as a fixed quantity rather than an approximate agricultural weight.
5. Orders
By placing an order, you confirm that the information provided by you is complete and accurate.
We reserve the right to refuse or cancel an order where reasonably necessary, including because of:
- stock or harvest unavailability;
- an obvious error in product information or pricing;
- unsuccessful or incomplete payment;
- suspected fraudulent activity;
- an undeliverable address;
- restrictions imposed by courier or logistics providers; or
- circumstances outside our reasonable control.
If we cancel a prepaid order that we are unable to fulfil, the applicable amount paid will be refunded.
6. Prices and Payment
All prices displayed on the website are in Indian Rupees (INR) unless stated otherwise.
Applicable taxes will be included or displayed as required.
Prices may change from time to time.
The price applicable to an order will normally be the price displayed when the order is placed, except where an obvious technical or pricing error has occurred.
Payments may be processed through authorised third-party payment providers.
We do not directly store complete payment-card details.
7. Discounts and Promotional Offers
Discount codes, coupons and promotional offers may be subject to specific conditions concerning:
- validity periods;
- eligible products;
- minimum order values;
- maximum discounts;
- number of permitted uses; or
- customer eligibility.
Unless expressly stated otherwise, promotional discounts cannot be exchanged for cash.
Promotional offers may be changed or withdrawn before an order is placed.
Where an offer has been obtained through fraud, technical manipulation or clear misuse, we reserve the right to cancel the discount or affected order, subject to applicable law.
8. Shipping and Delivery
We currently accept orders for delivery within India only.
Orders are transported using third-party courier and logistics providers.
Any delivery period displayed on the website is an estimate and not an absolute guaranteed delivery date.
Orders originating from Himalayan and remote agricultural regions may occasionally be affected by:
- weather;
- heavy rainfall;
- snowfall;
- landslides;
- road closures;
- natural disasters;
- harvest delays;
- courier disruptions;
- public holidays; or
- circumstances otherwise outside our reasonable control.
Customers are responsible for providing an accurate and complete delivery address, PIN code and contact number.
If an order is returned because of an incorrect or incomplete address, repeated unsuccessful delivery attempts, refusal to receive the shipment or another circumstance attributable to the recipient, additional shipping charges may apply before the order can be dispatched again.
9. Damaged, Incorrect or Defective Products
Please inspect your order promptly after delivery, particularly where it contains fresh or perishable produce.
If a product arrives:
- materially damaged;
- spoiled;
- broken or leaking;
- incorrect;
- materially different from what was ordered; or
- affected by a genuine fulfilment or transit problem,
please contact us within 24 hours of delivery wherever reasonably possible.
Please provide:
- the order number;
- clear photographs of the affected product;
- photographs of the outer and inner packaging where relevant; and
- a brief description of the problem.
Prompt reporting is particularly important for fresh and perishable products because their condition can change after delivery.
Where reasonably required, we may request further photographs or information necessary to assess a claim.
Depending upon the circumstances, an eligible claim may result in a replacement, refund or other appropriate resolution.
The 24-hour reporting requirement helps us establish the condition of perishable goods at delivery. It does not remove statutory consumer rights that cannot lawfully be waived.
10. Change-of-Mind Returns
Because we sell food and agricultural products, we do not accept returns merely because a customer changes their mind, including where the food product remains unopened.
This is necessary for food-safety, hygiene, traceability and quality-control reasons.
This restriction does not apply where the goods are defective, damaged, incorrectly supplied, materially different from their description or where the customer is otherwise legally entitled to a remedy.
11. Fresh and Perishable Produce
Fresh fruit and other perishable agricultural products should be inspected and stored appropriately after delivery.
Once delivered, deterioration caused by improper storage, excessive heat, moisture, delayed unpacking, contamination or handling after delivery is not considered a product defect attributable to Barahnaja Organics.
Storage and handling instructions provided on the product page, label or packaging should be followed where applicable.
12. Honey
Honey is a natural agricultural product.
Depending upon floral source, season and temperature, natural honey may:
- crystallise;
- thicken;
- become partially or completely granulated;
- vary in colour;
- vary in aroma;
- vary in flavour; or
- develop different textures between batches.
Natural crystallisation does not by itself indicate that honey is spoiled or defective.
Where honey is described by floral source, region or harvest, the corresponding product page should be referred to for specific information about that honey.
Honey should not be fed to infants under 12 months of age.
13. Ghee and Other Natural Foods
Ghee and other minimally processed agricultural foods may display reasonable batch-to-batch variations in colour, aroma, consistency or texture arising from season, raw material and production conditions.
These natural variations do not by themselves constitute defects where the product remains safe and conforms to the product description.
14. Allergens and Shared Packing Facility
Certain products sold by Barahnaja Organics inherently contain or are derived from allergens, including products containing milk, soy and sesame.
Our products are packed or handled within a facility where milk, soy and sesame are also handled.
Although reasonable care is taken during packing and handling, customers with serious food allergies or sensitivities should carefully review the product label and ingredient information before consumption.
Where required, allergen information on the product packaging should be treated as the primary product-specific declaration.
If you have a severe food allergy and require additional information about a particular product before purchasing, please contact us.
15. Food, Nutrition and Traditional-Use Information
Our website may contain information about ingredients, nutritional characteristics, traditional culinary use, agricultural practices or the historical use of certain foods.
Unless expressly stated otherwise, such information is provided for general informational purposes.
It is not intended as medical advice and is not intended to diagnose, treat, cure or prevent any disease.
Customers with medical conditions, allergies, dietary restrictions or specific nutritional requirements should seek appropriate professional advice where necessary.
16. Gift Packs and Sampler Sets
Gift packs, sampler sets and product combinations contain the products described on their respective product pages at the time of purchase.
We do not automatically substitute a different food product merely because one advertised product becomes unavailable.
If an advertised component of a gift pack becomes unavailable before fulfilment and the pack cannot be supplied as described, we may:
- contact the customer about available options;
- temporarily make the gift pack unavailable; or
- cancel and refund the affected order where necessary.
Minor changes to decorative presentation, packing materials or arrangement may occur between production batches without changing the essential products purchased.
17. Product Availability and Stock
Stock displayed on the website may change quickly, particularly for limited-harvest agricultural products.
In rare cases, an item may become unavailable after an order has been placed because of inventory reconciliation, crop loss, damage or another operational issue.
If this occurs and we cannot fulfil the affected item, we will contact the customer where necessary and provide an appropriate refund for the unavailable product.
18. Returns, Refunds and Cancellations
Returns, replacements, refunds and cancellations are additionally governed by our Refund Policy.
The Refund Policy should be read together with these Terms of Service.
Nothing in these Terms or our Refund Policy is intended to remove any statutory right available to a consumer under applicable Indian law.
19. Accuracy of Website Information
We make reasonable efforts to ensure that product descriptions, prices, photographs, availability information and other website content are accurate.
However, occasional typographical, technical or administrative errors may occur.
We reserve the right to correct errors and update information where reasonably necessary.
Where an error materially affects an order that has already been placed, we may contact the customer before fulfilment or offer an appropriate cancellation or refund.
20. Reviews, Questions and Customer Content
Where customers submit reviews, photographs, questions, comments, feedback or other material, they confirm that the content submitted is lawful and does not infringe another person's rights.
We may display genuine customer reviews, questions and submitted content on our website and associated brand channels.
We reserve the right to moderate or remove spam, abusive material, unlawful content, fraudulent reviews or content unrelated to the relevant product or service.
21. Intellectual Property
Unless otherwise stated, content appearing on the Barahnaja Organics website—including:
- photographs;
- product photography;
- written content;
- packaging artwork;
- illustrations;
- graphics;
- logos;
- brand elements; and
- website content—
is owned by, licensed to or lawfully used by Himalayan Harvest and/or the respective rights owner.
Content may not be commercially reproduced, republished, copied, sold or distributed without appropriate permission except where permitted by law.
The use of the Barahnaja Organics trade name by Himalayan Harvest does not transfer ownership of that trade name to Himalayan Harvest.
22. Prohibited Use
You may not use this website:
- for unlawful or fraudulent purposes;
- to interfere with the operation or security of the website;
- to transmit malicious software;
- to gain unauthorised access to systems or customer information;
- to infringe intellectual-property rights;
- to submit deliberately false or misleading information; or

25. Limitation of Liability
To the maximum extent permitted by applicable law, Himalayan Harvest / Barahnaja Organics will not be responsible for indirect or consequential loss arising solely from circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
Nothing in these Terms affects statutory rights available to consumers.
26. Privacy
Personal information collected through our website is handled in accordance with our Privacy Policy.
The Privacy Policy should be read together with these Terms of Service.
27. Changes to These Terms
We may update these Terms from time to time to reflect changes to:

- our operational practices; or

The current version will be published on this page with its latest revision date.
28. Governing Law
These Terms are governed by the laws of India.
Nothing in this provision limits any right a consumer may have to approach a competent consumer commission, statutory authority or other forum available under applicable law.
Subject to those statutory rights, disputes arising from these Terms will be subject to the jurisdiction of the competent courts in Uttarakhand, India.
